Judge Grants 90-Day Stay On Ruling Against DC Carry Ban

On July 29, the Washington DC attorney general’s office secured a 90-day stay on the ruling against the city’s ban on carrying handguns in public. 

On July 26 Breitbart News reported that federal Judge Frederick J. Scullin, Jr., ordered the ban halted “unless and until” DC adopted “a constitutionally valid licensing mechanism.” He said “the total ban on the public carrying of ready-to-use handguns outside the home” was not “constitutional under any level of scrutiny.”

The DC’s Office of Attorney General (OAG) responded to Scullin’s ruling by seeking a stay “to stop the ruling from going into effect during any appeal.”

According to The Washington Times, the OAG still “hasn’t [yet] settled on a strategy” for appeal and DC Mayor Vincent C. Gray is pushing the city council to “address the ruling” via legislation. The mayor’s spokeswoman said, “He doesn’t want to wait to see if they will hear an appeal.”

In the meantime, DC Metro Police Chief Cathy L. Lanier has instructed her officers that “all laws related to firearms regulation and crime remain in effect.”
