The Brady Center to Prevent Gun Violence, together with Sandy and Lonnie Phillips, are filing a lawsuit against against Lucky Gunner–“which operates BulkAmmo.com”–which is where alleged Aurora theater gunman James Holmes bought ammunition.
The Phillips’ daughter, Jessica Ghawi, was killed during a July 2012 attack on theater goers for which Holmes has yet to face trial.
According to the Aurora Sentinel, the suit will be filed in the Arapahoe County District Court as part of the Brady Center’s “national campaign against ‘Bad Apple’ gun dealers.” The Brady Center says the suit will be “the first in the nation against online sellers of ammunition and military equipment.” It alleges that the ammunition retailer did not “use any screening mechanism to determine [Holmes’] identity or intent for the products.”
As Breitbart News previously reported, Holmes did pass background checks for the purchase of his firearms.
On September 10, Breitbart News also reported that the Brady Center and Lindsay Fox were suing In Site Firearms for selling the gun that police say was eventually used to shoot and kill her husband, Officer Brad Fox. The individual who bought the gun has been imprisoned and admitted “lying on gun purchase applications,” but the Brady Center is still suing as a way to hold “‘Bad Apple’ gun dealers… accountable.”
